These Terms of Service (“Terms”) govern your use of https://onendunncards.com/ and any purchases you make from OneNDunn Cards (“OneNDunn Cards,” “we,” “us,” or “our”). By visiting our website, creating an account, or placing an order, you agree to these Terms, our Refund Policy, and our Privacy Policy. If you do not agree, please do not use our website. Our store is hosted on [Shopify], which provides the platform we use to sell our products to you.

You must be at least 18 years old, or the age of majority where you live, to make a purchase. If you are younger, you may use the site only with the involvement and consent of a parent or legal guardian, who is responsible for your use and purchases.

If you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for keeping your password secure and for all activity under your account. Let us know right away if you believe your account has been accessed without permission. We may suspend or close accounts that violate these Terms.

We work hard to describe and photograph our products accurately. However:

• Photos: Unless a listing states that you will receive the exact item pictured, photos may be stock images or representative examples. Colors and details may appear differently on your screen.
• Raw card condition: Condition grades for ungraded cards (for example, Near Mint, Lightly Played) are our good-faith assessment and involve some judgment.
• Third-party grades: Grades from PSA, BGS, SGC, CGC, or any other grading company are the opinion of that company. We do not guarantee that a card would receive the same grade if regarded, and we are not responsible for any grader’s decisions.
• Sealed product: Packs, boxes, and other sealed products contain randomly assorted contents. We make no guarantee about the cards or value you will receive.
• Card values: Market prices for collectibles go up and down. We make no promises about the current or future value of any item.

Prices are listed in U.S. dollars and may change without notice. Occasionally, our website may contain errors in pricing, product descriptions, or availability. We reserve the right to correct any error and to cancel or refuse any order affected by an error, even after it has been placed or payment has been taken. If we cancel a paid order, we will refund your payment in full.

Your order is an offer to buy. We may accept or decline it for any lawful reason. To keep things fair for collectors, we may:

• Limit quantities per customer, household, account, payment method, or shipping address.
• Cancel orders that appear to be placed by bots, automated scripts, or in violation of posted purchase limits.
• Limit or cancel orders that, in our judgment, appear to be placed by resellers or distributors.
• Cancel orders we suspect are fraudulent.

If we cancel your order, we will notify you using the contact information you provided and refund any amount charged.

We accept payment through [Shopify Payments, PayPal, and other methods shown at checkout]. You agree that you are authorized to use the payment method you provide. Payment information is processed securely by our payment providers. We do not store your full card number. Applicable sales tax will be added at checkout.

We ship to addresses within [the United States]. Shipping times are estimates and not guaranteed. Title and risk of loss pass to you when we hand your order to the carrier. We will still help you with lost or damaged shipments as described in our Refund Policy. Please double-check your shipping address. We are not responsible for orders shipped to an address you entered incorrectly.

All sales are final, except as described in our Refund Policy, which is part of these Terms.

Release dates, quantities, and product details may change and are outside our control. Your payment method may be charged [at the time of order / when the item ships]. If we receive fewer units than expected from our supplier, we may be unable to fill some preorders. In that case, we will cancel the affected order and issue a full refund. Preorder cancellations by you are handled as described in our Refund Policy.

Gift cards and store credit can be used only on our website [and in our Bloomington store], are not redeemable for cash except where required by law, and cannot be resold. All content on our website created by us, including text, original photos, logos, and design, belongs to OneNDunn Cards and may not be copied or used without our written permission. Card names, game names, logos, characters, and artwork shown on our website are trademarks and copyrights of their respective owners (for example, The Pokémon Company, Wizards of the Coast, Konami, Panini, Topps/Fanatics, Upper Deck, and others). OneNDunn Cards is an independent retailer and is not affiliated with, sponsored by, or endorsed by any of these companies.

You agree not to:

• Use the website for any unlawful purpose or in violation of these Terms.
• Use bots, scripts, scrapers, or other automated tools to access the site, monitor inventory, or place orders.
• Interfere with the site’s security or operation, or upload viruses or harmful code.
• Provide false information, impersonate others, or use someone else’s payment method without authorization.
• Harass, abuse, or threaten our staff or other customers.
• Copy, resell, or commercially exploit our website content without permission.

If you post reviews, comments, or other content, you are responsible for it. It must be honest, lawful, and respectful, and must not infringe anyone’s rights. You give us a non-exclusive, royalty-free, perpetual right to use, display, and share your content in connection with our business. We may remove content at our discretion.

Our website may link to third-party websites or use third-party tools. We do not control and are not responsible for their content, products, or practices. Your use of them is at your own risk and subject to their terms.

Except as expressly stated in these Terms or our Refund Policy, our website and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, OneNDunn Cards and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost value of collectibles, arising from your use of the website or any product. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some states do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold harmless OneNDunn Cards and its owners, employees, and agents from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the website, or your violation of any law or the rights of another person.

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Any legal action relating to these Terms or your purchases must be brought in the state or federal courts located in Monroe County, Indiana, and you consent to those courts’ jurisdiction.

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with our Refund Policy and Privacy Policy, are the entire agreement between you and us regarding your use of the website.

We may update these Terms from time to time. Changes take effect when posted on this page with a new “Last updated” date. Your continued use of the website after changes are posted means you accept the updated Terms. Changes will not apply to orders placed before the update.

If you opt in to text messages, you agree to receive recurring automated marketing and order-related messages from OneNDunn Cards at the number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help at any time. Carriers are not liable for delayed or undelivered messages. We do not share or sell your mobile number or text opt-in data with third parties for their own marketing purposes.
